These Terms of Service govern your access to and use of SexyBarista.com and any purchases made through the website.

The website is operated by Sexy Barista LLC, referred to in these Terms as “Sexy Barista,” “we,” “us,” or “our.”

By visiting our website, creating an account, submitting information, or purchasing a product, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy, and Refund and Replacement Policy.

Please do not use the website or place an order if you do not agree to these Terms.

1. Online Store Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase through the website.

You agree to provide current, complete, and accurate information when placing an order or creating an account. You are responsible for maintaining the confidentiality of your account access information and for activity conducted through your account.

You may not use our products or website for any unlawful or unauthorized purpose.

2. Products and Product Information

Sexy Barista sells roasted coffee, artisan coffee cups, apparel, accessories, gift sets, and other coffee-related merchandise.

We make reasonable efforts to describe and display our products accurately. However:

Product colors may vary depending on your screen or device.
Coffee flavor descriptions are based on professional and supplier tasting information but remain subjective.
Natural agricultural products may vary slightly between harvests and batches.
Packaging may be updated without notice.
Product photographs may include props or accessories that are not included unless specifically stated.
Product availability, bag sizes, grind choices, and packaging may change.

Coffee tasting notes are intended to describe potential flavor characteristics. They do not mean that flavors, syrups, or artificial ingredients have been added unless the product description specifically states otherwise.

3. Coffee Preparation and Grind Selection

Customers are responsible for selecting the correct coffee size, quantity, and grind option before completing an order.

Grind performance may vary depending on the brewing equipment, water, recipe, and preparation method used by the customer. We cannot guarantee that a selected grind will be perfectly calibrated for every coffee machine or brewing device.

Whole-bean coffee is recommended for customers with access to an appropriate grinder who want maximum control over preparation.

4. Prices and Payments

All prices are displayed in United States dollars unless otherwise stated.

Prices, discounts, promotions, and product availability may change without notice. The price displayed during checkout is the price applicable to that order, subject to correction of obvious errors.

Customers agree to provide valid and accurate billing and payment information. By submitting payment information, you represent that you are authorized to use the selected payment method.

Applicable sales tax, shipping charges, and other fees will be displayed during checkout when required.

5. Orders and Order Acceptance

Submitting an order does not guarantee acceptance.

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including:

Product unavailability.
Incorrect pricing or product information.
Suspected fraud or unauthorized payment activity.
Orders placed for unauthorized resale.
Shipping restrictions.
Technical or inventory errors.
Violation of these Terms.

If payment has already been collected for an order we cancel, the applicable amount will be refunded to the original payment method.

We may limit quantities purchased per person, household, account, payment method, or order.

6. Order Changes and Cancellations

Because coffee may be roasted, ground, and packed specifically for your order, we cannot guarantee changes or cancellations after processing begins.

An order cannot be canceled after it has shipped.

7. Shipping and Delivery

Orders are processed and shipped according to our published Shipping Policy.

Coffee orders are generally prepared for shipment within the processing timeframe stated on the website. Carrier transit estimates begin after the order has been transferred to the carrier.

Delivery dates are estimates and may be affected by weather, holidays, carrier disruptions, incorrect addresses, and circumstances beyond our reasonable control.

Customers are responsible for entering a complete and accurate shipping address.

8. Returns, Replacements, and Refunds

Returns, replacements, store credits, and refunds are governed by our published Refund and Replacement Policy.

Because roasted coffee is a consumable product, coffee purchases are generally final sale except when a product arrives damaged, compromised, incorrect, missing, or otherwise defective.

Eligible unused merchandise may be returned in accordance with the conditions and deadlines stated in the Refund and Replacement Policy.

9. Subscriptions

When you purchase a Sexy Barista coffee subscription, you authorize Sexy Barista and its payment providers to automatically charge your selected payment method according to the delivery schedule and price displayed during checkout.

Available subscription delivery schedules currently include:

Every 15 days
Every month
Every 2 months
Every 3 months

Available schedules may vary by product.

New subscriptions receive 20% off the first subscription order. Beginning with the second recurring order, active subscriptions receive 10% off each scheduled recurring delivery, subject to the terms displayed when the subscription is created.

Customers may use the Appstle subscription-management portal to perform available actions, which may include:

Skipping an upcoming delivery
Pausing or resuming a subscription
Changing the delivery schedule
Changing eligible products or quantities
Updating a shipping address
Updating payment information
Canceling the subscription

Changes must be completed before the next scheduled billing date to be reflected in the upcoming order.

A change or cancellation submitted after an order has already been charged, roasted, packed, or entered fulfillment may apply only to future deliveries. Canceling a subscription prevents future recurring charges but does not automatically cancel or refund an order that has already been processed.

Subscriptions renew automatically unless canceled, in accordance with our Purchase Options Cancellation Policy. Subscription discounts generally cannot be combined with other discounts unless a promotion specifically states otherwise.

10. Promotions and Discount Codes

Promotions and discount codes:

Are subject to their stated conditions and expiration dates.
May not be combined unless expressly permitted.
Have no cash value.
May be limited to one use per customer or household.
May exclude certain products, bundles, subscriptions, or gift cards.
May be changed or discontinued as permitted by law.

Discounts generally do not apply retroactively to previously completed purchases.

11. Gift Cards

Gift cards are subject to any terms displayed at the time of purchase.

Gift cards:

Cannot generally be exchanged for cash except where required by law.
Should be protected like cash.
May not be replaced if lost, stolen, or used without authorization.
May not be purchased or used for fraudulent or unlawful purposes.

12. Customer Reviews and Submitted Content

Customers may have opportunities to submit reviews, photographs, comments, testimonials, or other content.

By submitting content, you confirm that:

You own it or have permission to submit it.
It is truthful and based on your actual experience.
It does not violate another person’s rights.
It does not contain unlawful, abusive, deceptive, defamatory, or malicious material.
It does not contain malware or harmful code.

You grant Sexy Barista a non-exclusive, worldwide, royalty-free right to use, reproduce, display, edit, and share submitted content for business and marketing purposes, subject to applicable law and our Privacy Policy.

We may remove submitted content that violates these Terms.

13. Prohibited Uses

You may not use the website:

For unlawful, fraudulent, or deceptive activity.
To violate intellectual property rights.
To submit false or misleading information.
To transmit viruses, malware, or harmful code.
To interfere with the website’s security or operation.
To collect information about other users without authorization.

Nothing on the website grants a license to use Sexy Barista trademarks, branding, or proprietary material.

Information on the website concerning coffee, brewing, caffeine, flavor, or general wellness is provided for educational and informational purposes only.

It is not medical advice and should not be used to diagnose, treat, cure, or prevent a medical condition.

To the extent permitted by law, you agree to indemnify and hold Sexy Barista harmless from claims, losses, liabilities, and reasonable expenses arising from:

Your unlawful use of the website.
Your violation of these Terms.
Your infringement of another person’s rights.
Content you submit through the website.

This section does not apply where prohibited by applicable consumer law.

22. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where mandatory consumer laws provide otherwise.

Subject to any rights that cannot legally be waived, disputes relating to these Terms or purchases from Sexy Barista will be handled by an appropriate state or federal court located in Miami-Dade County, Florida.

23. Severability

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect.

Failure to enforce a provision does not waive the right to enforce it later.
